These Terms of Service ("Terms") govern your use of the website and roadside assistance dispatch services provided by SOS Roadside ("SOS Roadside," "we," "us," or "our"). By requesting service or using our website, you agree to these Terms.

1. Our Service

SOS Roadside is a roadside assistance dispatch and coordination service. We receive your request, match you with an independent third-party service provider in our network, coordinate the job, and facilitate communication and payment. We are a dispatch and coordination company.

2. Independent Service Providers

The towing operators and roadside technicians dispatched to assist you are independent contractors, not employees of SOS Roadside. While we work to match you with qualified providers, SOS Roadside does not directly perform the towing, repair, or recovery work and is not responsible for the acts or omissions of independent providers beyond our coordination role.

4. Cancellations And Gone-On-Arrival

If you cancel after a provider has been dispatched, or if the provider arrives and you or your vehicle are no longer at the location, a gone-on-arrival or cancellation fee may apply to cover the provider's dispatched time and travel.

5. Text Messaging

If you opt in to text messages, you agree to receive transactional messages related to your service request. Message frequency varies, and message and data rates may apply. Reply STOP to opt out or HELP for help. See our Privacy Policy for details on how we handle your information.

6. Your Responsibilities

You agree to provide accurate information about your location, vehicle, and the assistance you need, and to be present and reachable so service can be completed safely. You are responsible for the safety of yourself and your passengers while awaiting service.

7. Limitation Of Liability

To the fullest extent permitted by law, SOS Roadside is not liable for indirect, incidental, or consequential damages arising from your use of our services or the services performed by independent providers. Our total liability for any claim is limited to the amount you paid for the specific service giving rise to the claim.

8. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles.

9. Changes To These Terms

We may update these Terms from time to time. Continued use of our services after changes take effect constitutes acceptance of the revised Terms.
